Criminal Defense
Commonwealth v. Whitt – Montgomery Circuit Court. Obtained dismissal of a felony criminal mischief indictment four (4) days prior to jury trial date.
Commonwealth v. Fugate – Clark Circuit Court. Client who confessed faced life in prison on felony burglary and first-degree persistent felony offender charges pled to amended charges on the first day of jury trial following jury selection and received 30 month sentence.
Commonwealth v. Hurst – Clark District Court. Hung jury (no verdict) on 2nd offense DUI charge resulting in amendment of charges to Operating Contrary to Law with fine penalty.
Commonwealth v. Palmer – Clark County. Jury verdict of acquittal on a charge of assault – 4th degree.
Commonwealth v. Sparks – Montgomery County. Jury verdict of acquittal on charges of 1st degree sodomy and 1st degree sexual abuse.
Commonwealth v. Davis – Clark County. Jury verdict of acquittal on charges including disorderly conduct.
Commonwealth v. James – Fayette County. Jury verdict of acquittal on charges including DUI (operating a motor vehicle under the influence).
Commonwealth v. Turner – client charged with DUI-2nd offense. Suppression of blood alcohol test results by defense motion resulted in amendment of charges to non-DUI offense and fine paid by client.
Civil
Evans and Gilbert v. Crump – Clark Circuit Court. Prosecuted breach of contract claims on behalf of clients resulting in an award of $110,000 plus interest and attorney fees at bench trial in contract dispute concerning purchase of a business.
Mitchell v. Anderson – Clark Circuit Court. Successfully defended client in automobile negligence action with jury verdict of no liability and, in the same lawsuit, recovered from plaintiff the deductible for property damage to client’s vehicle.
Circle C, LLC v. RRG Basecamp, LLC – Wolfe Circuit Court. Successfully defended owner/operator of lodge for the climbing community against claims asserted by neighboring property owner of ownership via deed and adverse possession in bench trial.
Personal Injury
Stephens v. Stephens – Clark County. Jury verdict of no liability and finding for the defense on all counts in claim by invitee on property where plaintiff sustained injury to his foot amputating multiple toes.
Dalton v. Kmart – Madison County. Jury verdict in favor of plaintiff in the amount of $125,000 for injuries sustained in slip and fall.
Wrongful death action prosecuted in Fayette County. Settled in advance of trial for policy limits of $1,100,000.
Co Counsel in personal injury wrongful death vehicular case in 2018 in Fayette Circuit Court involving major manufacturer and Fortune 500 companies resulting in a settlement prior to trial in excess of $3,000,000.
Real Estate
Burns v. Wells – Madison County. Jury verdict in favor of plaintiff, Burns, in boundary line dispute.
Durbin v. Flynn – Estill County. Judge alone verdict in favor of plaintiffs in boundary line dispute.
Represented large construction company regarding request for a land use zone change to operate a quarry on previous agricultural land with a favorable result before the planning commission and local government which was affirmed by the Kentucky Court of Appeals and Supreme Court of Kentucky; Southwest Clark Neighborhood Association Inc v Clark County Fiscal Court, Supreme Court No. 2017-SC-00253, Court of Appeals No 2015-CA-01645.
Represented a local developer defending suit to interpret restrictive covenant so as to allow the placement of a new car dealership on land restricted against the placement of a used car lot. Norton Family Trust v S. J. Land Holding, LLC, Supreme Court No. 2015-SC-00126, Court of Appeals No 2013-CA-01552.
